GENERAL CONDITIONS OF SALE (GCS) Valid from 08/30/2025
These General Conditions of Sale ("GTC") govern the offer and sale of products via the website www.gioielleriafiorenza.it ("Site").

(hereinafter referred to as the "Seller")
Customers who make purchases on the Site (hereinafter "Customer") declare that they are a consumer, i.e., a natural person acting for purposes outside of any entrepreneurial, commercial, artisanal, or professional activity they may carry out, or a professional or company, depending on the section of the Site or the type of registration they have made.
Art. 1 - Scope of application and modification of the GTC
1.1 These GTC apply to all orders placed on the Site.
1.2 Before placing an order, the Customer is required to carefully read these GTC, available on the Site. Sending the order implies full acceptance of the GTC.
1.3 The Seller reserves the right to modify these GTC at any time, provided that such modifications will not have retroactive effect on orders already accepted and confirmed. The applicable GTC are those in effect at the time the order is placed.
Art. 2 - Products
2.1 The essential characteristics of the products are presented on the Site within each product page. Product images are for illustrative purposes only and may not be fully representative of their characteristics, as they may differ in color and size.
2.2 Product availability indicated on the Site is purely indicative and not binding. If one or more products ordered are unavailable after the order has been placed, the Seller will promptly notify the Customer, who will have the right to choose whether to cancel the order, receive a replacement product (if available and of equivalent value), or wait for restocking.
Art. 3 - Prices
3.1 Product prices are expressed in Euros (€) and include VAT (if applicable and specified).
3.2 Prices do not include shipping costs, which will be indicated separately before confirming the order.
3.3 The Seller reserves the right to change prices at any time, but the products will be invoiced at the price in effect at the time the order is placed.
Art. 4 - Order and conclusion of the contract
4.1 To place an order, the Customer must select the desired products and add them to the virtual shopping cart.
4.2 The purchasing process involves filling out a form with your personal and shipping information, choosing a payment method, and viewing an order summary.
4.3 Before confirming the order, the Customer is invited to carefully check all the data entered and to accept these GTC by clicking on the appropriate box.
4.4 The Customer's submission of an order constitutes a contractual offer to purchase. The contract is deemed concluded only when the Seller sends the Customer an order confirmation email, which summarizes the products purchased, the price, shipping costs, and delivery information.
4.5 The Seller reserves the right not to accept an order in the event of product unavailability, errors in the data provided by the Customer, or for any other legitimate reason, and will notify the Customer accordingly.
Art. 5 - Payments
5.1 The Customer can choose between the following payment methods:* Credit card (Visa, MasterCard, American Express, etc.)* PayPal* Advance bank transfer (the order will be processed only upon receipt of payment)* [Other payment methods offered, e.g. Cash on delivery, Klarna, etc.]
5.2 If paying by credit card, the charge will be made only when the products are shipped. For payments by PayPal, the charge will be made upon order confirmation.
5.3 All financial transactions are handled by secure payment service providers (e.g. Stripe, PayPal) and the Seller does not store the Customer's sensitive credit card data.
Art. 6 - Shipping and delivery
6.1 The Seller ships to [list of countries or geographical areas to which it ships].
6.2 Estimated delivery times are indicated in the "Shipping" section of the Site and in the order confirmation email. These times are indicative and not binding.
6.3 Shipping costs are the responsibility of the customer and are indicated before order confirmation. They may vary based on the destination and weight/volume of the products.
6.4 Upon delivery, the Customer is required to check the integrity of the packaging and the conformity of the products received with the order. Any damage or discrepancies must be immediately reported to the courier and communicated to the Seller within [number] days of delivery.
Art. 7 - Right of withdrawal (for consumers only)
7.1 Pursuant to the Consumer Code (Legislative Decree 206/2005), the consumer Customer has the right to withdraw from the contract without giving any reason, within 14 days from the day on which the Customer or a third party designated by him (other than the carrier) acquires physical possession of the goods.
7.2 To exercise the right of withdrawal, the Customer must inform the Seller of his or her decision via an explicit declaration (e.g., a letter sent by post, fax, or email) to the contact details indicated in Article 1. It is possible to use the standard withdrawal form on the Site, but it is not mandatory.
7.3 In the event of withdrawal, the Customer must return the products intact, in their original packaging and complete with all accessories, to the Seller without undue delay and in any case within 14 days from the day on which the withdrawal was communicated. The direct costs of returning the goods are borne by the Customer.
7.4 The Seller will refund all payments received from the Customer, including delivery costs (with the exception of additional costs resulting from the Customer's choice of a delivery method other than the least expensive standard delivery method offered by the Seller), without undue delay and in any case within 14 days from the day on which the Seller is informed of the Customer's decision to withdraw from the contract. The refund may be suspended until the goods are received or until the Customer demonstrates having returned the goods, whichever is earlier.
Art. 8 - Legal guarantee of conformity (for consumers only)
8.1 For products purchased by the consumer Customer, the Seller offers the legal guarantee of conformity provided for by Articles 128 et seq. of the Consumer Code. This guarantee covers defects of conformity existing at the time of delivery of the goods and which become apparent within two years of delivery.
8.3 The Customer must report the lack of conformity to the Seller, under penalty of forfeiture, within two months of the date on which he discovered the defect.
Art. 9 - Responsibility
9.1 The Seller is not responsible for disruptions attributable to force majeure or unforeseeable circumstances, even if caused by malfunctions or disruptions of the Internet, in the event that it is unable to fulfill the order within the timeframes set out in the GTC.
9.2 The Seller is not responsible for any direct or indirect damages resulting from improper use of the products.
Art. 10 - Applicable law and competent court
10.1 These GTC are governed by Italian law.
10.2 For any dispute relating to the application, execution, and interpretation of these GTC, the court of the Customer's place of residence or domicile, if a consumer, shall have exclusive jurisdiction. In all other cases, the court of [Seller's jurisdiction, e.g., Trapani] shall have exclusive jurisdiction.
Art. 11 - Processing of personal data
11.1 The Customer's personal data are processed by the Seller in compliance with EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003 and subsequent amendments.
11.2 For further information on the processing of personal data, the Customer is invited to consult the "Privacy Policy" available on the Site.
Art. 12 - Communications
12.1 All communications between the parties must be made in writing to the addresses indicated in these GTC or on the Site.
Art. 13 - Final clauses
13.1 Should one or more provisions of these GTC be held to be invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions.
